Principles Of Membership

Members will observe the highest principles of ethics, equity, integrity, professional conduct and fair practice in dealing with others and will conduct their business in a manner designed to enhance the operation, image and reputation of the recruitment industry. Ethical conduct is not simply compliance with legal requirements, but extends to honesty, respect for and equitable treatment of others, integrity and social responsibility. It is conduct that holds up to disclosure and public scrutiny. 

Members and their staff shall comply with all relevant legislation, statutory and non-statutory requirements and official guidance, and any future amendments to such requirements during the course of providing their services to others.  We are guided by nine key principles:

  1. Members will act honestly in all dealings with candidates, clients, members, non-members and others.
  2. In the course of representing a candidate or client, a member shall not knowingly make a false or inaccurate statement, fail to disclose a material fact, or make a representation as to future matters without having reasonable grounds for making it.
  3. Members must adhere to principles of truth in advertising and will only advertise positions, through any medium, for which they have documented permission to recruit.
  4. All fees, charges and services provided must be explicitly and fully disclosed to clients prior to the acceptance of an assignment or prior to any work being undertaken for a client.
  5. Candidates shall not be charged for basic registration services.
  1. Members will not undertake actions that may unfairly or unlawfully jeopardise a candidate’s employment.
  2. Members will not undertake actions that may unfairly or unlawfully interfere in work relationships established by others.
  3. Members will not attempt unfairly or unlawfully to prevent candidates from seeking work from other sources.
  4. In the event that a member has a concern/issue with another member’s actions, s/he should first seek to clarify the concern directly with that member before seeking to address the matter elsewhere. The Chair of the Organisation may be notified as a third party to arbitrate if deemed necessary.
  1. Members should adhere to the spirit of all applicable human rights, employment laws and regulations and will treat candidates, clients and other stakeholders without prejudice or unjustified discrimination.
  2. Members should not act on an instruction from a client that is discriminatory and should, wherever possible, provide guidance to clients in respect of good diversity, HR and IR practices.
  3. Members and their staff will treat all candidates and clients with dignity and respect, and aim to provide equity of employment opportunities based on objective business related criteria.
  4. Members should establish working practices that safeguard against unlawful or unethical discrimination in the operation of their business.

Members who engage in third party contracting will act diligently in assessing risks to candidates and will inform candidates of any health and safety concerns.

  1. Members will work diligently to develop and maintain a satisfactory level of relevant and current professional knowledge.
  2. Members will ensure that their staff are adequately trained and skilled to undertake their responsibilities in recruitment practice.
  1. Members must supply candidates with full details of conditions of employment, nature of the work to be undertaken, rates of pay, method and frequency of payment and pay arrangements in accordance with requirements of current legislation.
  2. Members will ensure that as far as is reasonably possible, any variation to candidate engagement only occurs with prior notification of, and agreement by, the candidate.
  1. Members will pay promptly and accurately any wages and benefits due in accordance with any agreed terms and legal requirements.
  2. Members will not take on assignments that could result in their inability to pay temporary/contract candidates.
  1. Members must observe the highest principles of integrity, professionalism, equity and fair practice to maintain the confidentiality and privacy of candidate and client information and should respect the confidentiality of records in accordance with law and good business practice.
  2. Members and their staff must ensure that they have obtained consent or that they have another legal basis which they can rely on (such consent or legal basis to be documented) before disclosing, transferring, displaying, submitting or seeking confidential or personal information.

CODE OF CONDUCT

  1. Members will strive to serve clients and candidates with honesty and with integrity at all times.
  2. Members shall make accurate claims concerning the services they offer to clients and candidates.
  3. Members shall uphold the principles of fair play and be vigilant against conduct which has the intent, capability or effect of being deceptive.
  4. Members support the recruitment industry through co-operation with clients, candidates and other businesses who would benefit from an ethical system.
  5. Members will honour all commitments and seek to resolve any disputes in a fair and expeditious manner, in accordance with legislation and best practice.
  6. Members acting for and on behalf of candidates seeking temporary, contract or permanent employment will supply the best possible advice and have their best interests represented at all times.
  7. Members agree that details contained in advertisements shall be clearly based on specifications taken from clients and that any description, terms and conditions advertised are truly representative.
  8. Members agree to obtain permission from a candidate before submitting their details to a client.
  9. Members agree to thoroughly brief all candidates accurately before they attend an interview with a client.
  10. Members agree to inform clients of any potential conflicts of interest before attempting to fill a vacancy.
  11. Members will fully inform clients and candidates of any environmental, safety or other hazards that may be detrimental to health and safety.
  12. Members will not act in a manner that will bring into disrepute the Organisation, its members or the recruitment industry.
  13. Members must comply with all the provisions of relevant legislation including but not limited to, Equal Opportunity Act, Maternity Protection Act, RSBA, OSHA and Industrial Relations Act.    
  14. Members will comply with all aspects of law and legislation appertaining to the recruitment industry and make available to candidates and clients alike the benefit of that knowledge, so that neither is being deprived of essential information and advice.
  15. Members agree that they will not approach a current employer for a reference without the express permission of the candidate.
  16. Members who obtain information supplied through a reference will treat the information as confidential to the recruitment process.
  17. Members agree not to speak on behalf of the Organisation on matters that are deemed political and/or controversial in nature, unless such matters are intended to advance the interest and/or objectives of the Organisation.
  18. Only the Secretariat of the Organisation is authorized to issue statements on behalf of the Organisation.

SERVICE COMMITMENT

It is reasonable that members should expect the Organisation and its representatives to act professionally. Therefore we at the Organisation pledge to act with integrity, honesty and transparency in our dealings with members and others alike, to retain confidentiality wherever required and to represent members’ interests as best we can.

Our pledge is to work to the highest ethical standards befitting of a representative trade organization.

In addition, we pledge that the Organisation will never act in a position of conflict of interest. For this reason the Organisation will not allow any person knowingly affiliated to a political party to act in a position of influence.

It is not our role to police the recruitment sector or our members, but we may address any complaint of non-compliance of our code of conduct by a member if required to do so.
